Trademarks in Thailand are registered with the Department of Intellectual Property under the Trademark Act B.E. 2534. An accepted application is published for opposition, with a 60-day opposition period from publication. Registration runs 10 years and is renewable for successive 10-year terms.

Why files get rejected

  • Thailand operates a first-to-file system. Prior use abroad does not by itself defeat an earlier Thai filing by someone else.
  • Descriptive marks and marks that merely indicate the character of the goods face objections. A distinctive mark filed narrowly usually outperforms a descriptive mark filed broadly.
  • The Madrid Protocol route can designate Thailand from an international registration, but examination and opposition still happen locally under the Trademark Act.
  • A registered trademark is not a company name, a domain, or a copyright. Overlapping protection has to be arranged deliberately.
  • No adviser can promise registration. A search reduces risk, it does not remove the examiner's discretion or a third party's right to oppose.

How long does trademark protection last in Thailand?+

Registration runs for 10 years from the filing date and is renewable for successive 10-year terms under the Trademark Act B.E. 2534. Missing a renewal is the most common way a long-held mark is lost.

How long is the opposition period?+

An application accepted by the examiner is published, and a third party may oppose within 60 days of publication. Monitoring the publication matters as much for your competitors' marks as for your own.

Can a foreign company own a Thai trademark?+

Yes. A foreign applicant registers in its own name, usually through a local agent with a power of attorney, and where the applicant is abroad that power may need notarisation and legalisation.

Should we use the Madrid Protocol or file directly?+

It depends on how many countries are in scope and how the portfolio will be managed. Thailand has been a Madrid Protocol member since 7 November 2017, so both routes are available; a single-country entry is often simpler filed directly.

Do we need a search before filing?+

It is not compulsory, but filing into a conflict wastes both the official fee and the months of examination. A search also shapes the specification so the application is easier to accept.
