The Board of Investment grants promotion under the Investment Promotion Act B.E. 2520 by reference to its published activity list. Each activity carries its own conditions and benefit set. Why files get rejected

  • Promotion is granted by activity. A company can hold promotion for one activity and be unpromoted for another; the accounting must keep them apart.
  • Benefit sets differ by activity and by the Board's current announcements. We do not quote a benefit until the activity is fixed, because the wrong figure at the planning stage is worse than none.
  • A promoted project carries conditions — capital, timing, reporting. Losing a benefit for a missed condition is more common than a refusal at the application stage.
  • BOI promotion can support work permit and visa facilitation for the project's foreign staff, but each of those remains a separate application under its own authority.
  • Approval is at the Board's discretion. No adviser can guarantee promotion or a particular benefit level.

Which businesses qualify for BOI promotion?+

Only activities on the Board's published activity list, and only where the project meets that activity's conditions. The list is revised over time, so the current announcement governs — an activity that qualified for a colleague's project two years ago may sit under different conditions today.

Does BOI promotion allow full foreign ownership?+

Promotion can permit foreign majority in activities that would otherwise be restricted, and it is one of the recognised routes alongside a Foreign Business Licence and Treaty of Amity certification. The permission attaches to the promoted activity, not to the company at large.

How long does the application take?+

It depends on project size and the Board's queue. Realistically the certified overseas documents, not the review, set the earliest possible filing date.

Can an existing company apply?+

Yes. An operating company can seek promotion for a new qualifying activity or an expansion, provided the promoted activity is separable in the accounts from the unpromoted business.

What happens after approval?+

The certificate must be accepted within the period stated, and the conditions begin. Reporting obligations continue for the life of the promotion, which is why we hand over a compliance calendar rather than just the certificate.
